BUKU karya Anom Surya Putra mengetengahkan kembali suatu diskursus hukum yang selama ini berada di tepian karena luput dari pengamatan dunia akademis, yaitu Restorasi Republik Desa sebagai Cara Berhukum dari Desa.
Republik Desa telah dikaji oleh akademisi kolonial pada masa kolonial Belanda di bumi nusantara. Sebut saja akademisi fenomenal kala itu, Cornelis van Vollenhoven yang menulis tentang kongsi-kongsi dagang imigran China di Kalimantan Barat sebagai Republik Desa (dorpsrepubliekjes; Belanda) dalam Het Adatrecht van Nederlandsh-Indië (hukum adat Hindia-Belanda) pada tahun 1931. Diskursus Republik Desa masa kolonial menemukan cara berhukum dari Desa yakni otonomi dan rekognisi terhadap Desa sebagai persekutuan-hukum adat (adatrechtsgemeenschappen; Belanda).
Walaupun demikian, Anom Surya Putra mampu mendeteksi kelemahan studi Republik Desa masa kolonial tersebut, yakni belum memberikan kemerdekaan, kedaulatan rakyat, dan demokrasi pada otonomi dan rekognisi Desa. Studi Republik Desa yang dilakukan pada masa kolonial menjadi masukan bagi pemerintah kolonial Belanda mengendalikan komunitas-organik Desa. Tidak lain agar Desa tetap bercokol dibawah koloni Belanda. Berbeda dengan studi hukum ala kolonial, titik tolak Restorasi Republik Desa ialah gagasan Tradisi Berdesa (bermasyarakat, berbangsa dan bernegara di ranah Desa) yang disuarakan oleh Sutoro Eko.
Bangunan diskursus Restorasi Republik Desa yang dilakukan oleh Anom sangat kokoh. Restorasi Republik Desa diposisikan sebagai Grand Theory yang bersifat sosiologis dengan mengikuti C. Wright Mills daripada Grand Theory normatif sebagaimana lazimnya dalam paradigma hukum doktrinal. Diikuti dengan Teori-Organik Badan Hukum (Genossenschafstheorie) oleh Otto von Gierke dan Teori Tindakan Komunikatif, Negara Hukum-Deliberatif oleh Jürgen Habermas dan Mathieu Deflem.
Pemikiran dari pakar Indonesia pun turut memperkuat rancang bangun Restorasi Republik Desa, yakni Soetandyo Wignjosoebroto, F. Budi Hardiman, dan Satjipto Rahardjo. Anom Surya Putra menjelaskan Grand Theory Restorasi Republik Desa pada hakekatnya adalah cara berhukum dari Desa, cara berhukum dengan hukum rekognisi, cara berhukum dengan hukum subsidiaritas, dan cara berhukum dengan tindakan komunikatif yang berlangsung antara Kepala Desa, Perangkat Desa, BUM Desa dan warga Desa.
Buku ini melakukan teoritisasi fenomena BUM Desa pada konteks kemandirian Desa. BUM Desa Tirta Mandiri di Desa Ponggok, Kecamatan Polanharjo, Kabupaten Klaten merupakan arena refleksi Anom dalam cara berhukum dari Desa.
Cara berhukum dari Desa pada buku ini merupakan bekal yang sangat baik agar Desa tidak dijejali oleh gagasan-gagasan akademis doktrinal yang terkesan canggih, padahal membunuh Desa. Dunia akademis ibarat kunci bagi gerbang kebijakan-kebijakan yang akan berlaku. Jika dunia akademis telah mengkaji Desa dengan cara Berdesa, maka para pemangku kebijakan semakin mampu melahirkan kebijakan yang membuat Desa menjadi mandiri dan sejahtera.
Oleh karena itu, buku ini sangat tepat dipelajari oleh kalangan akademisi, Kepala Desa beserta Perangkat Desa, lembaga kemasyarakatan Desa, aktivis-aktivis organisasi kemanusiaan, sosial dan politik. Diskursus yang sebenarnya terbilang rumit tapi mampu dituangkan dengan penulisan yang apik dan menarik.
Hanya saja buku ini cukup singkat untuk menguraikan diskursus yang tengah dikaji. Terlepas dari kekurangan tersebut, Anom Surya Putra mengajak kita untuk memiliki naluri dan nalar Republik Desa.*
