PENGANTAR Jürgen Habermas | Penerjemah: Anom Surya Putra | Di Jerman, filsafat hukum telah lama tidak lagi menjadi materi pembahasan bagi para filsuf. Jika saya jarang menyebut nama Hegel dan lebih mengandalkan teori hukum Kantian, hal ini juga mengungkapkan keinginan saya untuk menghindari suatu model yang menetapkan standar yang tidak dapat dicapai bagi kita. Memang, bukan kebetulan bahwa filsafat hukum, dalam mencari kontak dengan realitas sosial, telah bermigrasi ke aliran-aliran (mazhab) hukum. [1] Namun, saya juga ingin menghindari ilmu hukum teknis yang terfokus pada fundasi-fundasi hukum pidana. [2] Apa yang dulunya dapat dianut secara koheren dalam konsep-konsep filsafat Hegelian saat ini menuntut pendekatan pluralistis yang menggabungkan perspektif teori moral, teori sosial, teori hukum, serta sosiologi dan sejarah hukum. Perbincangan tentang Badan Usaha Milik Desa (BUM Desa) semakin kencang setelah lahirnya UU No. 6/2014 tentang Desa. BUM Desa bukanlah hal yang asing lagi. Nyaris semua pernah mendengar tentang BUM Desa mulai masyarakat Desa, aktivis/pegiat Desa, akademisi pembelajar Desa, aparatur pemerintahan supra-Desa dan pemerintah Desa.
Banyak mata tertuju padanya. Begitu pula banyak kepentingan didalamnya. Berjibun harapan ditumpukan dan diemban BUM Desa. Tapi perbincangan BUM Desa masih belum didukung oleh literasi yang mendalam tentang BUM Desa.
Menjawab Problem Hukum dan Administrasi Aset
Buku ini membahas dinamika BUM Desa ketika mengelola aset. Secara luas penulisnya menyajikan dinamika sosial-hukum Desa ketika mengelola potensi aset desa. Istilah 'penyerahan pengelolaan aset Desa' kepada BUM Desa menghasilkan banyak tafsir. Bagian cerita tentang BUM Desa Tirta Mandiri, Desa Ponggok, memberikan informasi yang runtut bahwa secara nyata BUM Desa mengelola potensi aset Desa dan aset Desa dengan implikasi hukum dan administrasi yang serius.
Memang BUM Desa dalam buku benar-benar nyata menjadi salah satu motor pengelolaan aset. Sisi menariknya, umbul Ponggok baru diketahui bukan 'aset Desa', tapi secara administratif merupakan aset pemerintahan provinsi. Tapi, penulisnya memunculkan anasir sosiologis bahwa umbul Ponggok dan umbul lain di Desa Ponggok adalah aset bersama. Aset yang hanya bisa dinikmati, dikelola, tapi tidak bisa dimiliki oleh Desa.
Banyak masalah yang muncul kaitan aset bersama, aset Desa, dan aset BUM Desa. Buku ini menjadi cermin bagi pengelola BUM Desa lain untuk berhati-hati memilih istilah 'penggunaan aset Desa', 'pemanfaatan aset Desa', dan bahkan 'aset BUM Desa yang diperoleh dari usaha BUM Desa'. Penggunaan dan pemanfaatan aset Desa tidak berarti seluruh aset Desa pindah tangan kepada BUM Desa. Kira-kira begitulah maksud dari penulisnya. Desa dengan gelar "mandiri" berarti berhasil mengelola aset Desa dan aset Bersama dengan beragam cara. Untuk meningkatkan pendapatan Asli Desa atau dilain pihak mengumpulkan kekuatan usaha dari warga Desa setempat.
Masalah krusial adalah memahami praktik BUM Desa itu yang sudah melampaui pemikiran akademis selama ini. Analisis sosiologi, filsafat, dan sejarah BUM Desa pada buku ini berdampak luas pada dunia hukum bisnis, hubungan keperdataan dan administrasi pemerintahan. Contoh pembahasan bisa kita lihat mengenai bentuk BUM Desa, pengelolaan BUM Desa, Unit Usaha BUM Desa yang terpilah dengan BUM Desa, dan penempatan yang pas perihal penyertaan modal oleh masyarakat Desa.
Aset yang dihasilkan oleh BUM Desa hingga saat ini masih belum selesai dalam perdebatan di semua level. Dan buku ini menyajikan temuan baru secara empiris dan refleksi teoritisnya. Bukan sekedar rancangan politik kebijakan skala nasional tanpa bukti (evidence).
Buku yang ditulis Anom Surya Putra merupakan salah satu instrumen yang mampu untuk menjawab pertanyaan rumit tentang aset BUM Desa pasca UU Desa. Asalkan pembaca tekun membaca buku tersebut yang sangat kental dengan telaah filosofis.
Penulisnya juga menyajikan historisitas politik Desa zaman sebelum Indonesia Merdeka sehingga menambah khazanah pengetahuan untuk peminat bacaan politik kesejarahan Desa dan BUM Desa.
Terlebih bagi pendamping Desa atau siapapun yang bergiat dengan Desa. Perbincangan BUM Desa nampak diabstraksikan dari dan kedalam tatanan sosial Desa. Ditulis dengan apik, enak dibaca dan tidak jenuh.
Kental dengan Jürgen Habermas
Penulis buku ini mengakui telah membedah masalah sosial Desa dan Badan Hukum BUM Desa melalui pemikiran Jürgen Habermas. Hasilnya, sepanjang isi buku secara bergantian kita temui kemampuannya mengkategorikan badan hukum BUM Desa sesuai dengan karakteristik Desa yang komunikatif dan deliberatif.
Hal itu merupakan penemuan hukum baru bagi indonesia tentang badan hukum BUM Desa sesuai dengan karateristik Desa. Cara berpikir Habermas tentang Hukum Deliberatif tidak diterapkan sepenuhnya. Bergantian dengan kerangka teoritis lainnya tentang Badan Hukum. Penulisannya menyasar mengkritik teori Badan Hukum itu sendiri.
Bisa saja akademisi hukum akan tertarik bahwa teori Badan Hukum selama ini tidak mampu menjawab permasalahan sosial Desa dan praksis BUM Desa mengelola aset Desa, aset bersama, dan potensi aset desa untuk kesejahteraan masyarakat Desa. Pengetahuan akuntansi keuangan BUM Desa disinggung sedikit oleh penulisnya untuk menunjukkan BUM Desa mampu mengelola aset itu secara transparan. Sedikit banyak penulisnya menyusun kriteria-kriteria Badan Hukum BUM Desa secara baru, nyata, dan tidak sekedar mengulang-ulang teori dan praktek politik kebijakan yang selama ini ada.
Tantangan kedepan adalah penulisnya bisa terus menerus melakukan transformasi kelembagaan BUM Desa sesuai dengan karakter sosial masyarakat Desa. Namun transformasi itu tidak keluar dari tatanan hukum Indonesia. Memang akan menjadi jalan panjang karena tatanan hukum Indonesia belum sepenuhnya berubah pasca UU Desa.
Tak berlebihan kiranya, kita ajukan penilaian kritis bahwa penulisnya harus menemukan pola BUM Desa yang cocok bagi Desa setempat, tergambar dalam bagan yang detail, mudah dipahami dan dioperasionalkan oleh Desa. Tentu penulisnya sebaiknya menulis buku baru yang lebih tipis. Dan ringan untuk dijalani oleh pengurus BUM Desa maupun pengelola Unit Usaha BUM Desa (perseroan terbatas).*
